The Kidawa.com Web Site (the "Site") is an online information service provided by Kidawa ("Kidawa.com "), subject to your compliance with the terms and conditions set forth below. 1. Copyright, Licenses and Idea Submissions.

YOU MAY NOT MODIFY, COPY, REPRODUCE, REPUBLISH, UPLOAD, POST, TRANSMIT, OR DISTRIBUTE, IN ANY MANNER, THE MATERIAL ON THE SITE, INCLUDING TEXT, GRAPHICS, CODE AND/OR SOFTWARE. You may print and download portions of material from the different areas of the Site solely for your own non-commercial use provided that you agree not to change or delete any copyright or proprietary notices from the materials. Except for Kidawa.com- identified information, products or services, all information, products and services offered through the Site or on the Internet generally are offered by third parties, that are not affiliated with Kidawa.com a. 3. Indemnification.

You agree to indemnify, defend and hold harmless Kidawa.com, its officers, directors, employees, agents, licensors, suppliers and any third party information providers to the Service from and against all losses, expenses, damages and costs, including reasonable attorneys' fees, resulting from any violation of this Agreement (including negligent or wrongful conduct) by you or any other person accessing the Service.

4. Third Party Rights.

The provisions of paragraphs 2 (Use of the Service), and 3 (Indemnification) are for the benefit of Kidawa.com and its officers, directors, employees, agents, licensors, suppliers, and any third party information providers to the Service. Each of these individuals or entities shall have the right to assert and enforce those provisions directly against you on its own behalf.

5.Term; Termination.

This Agreement may be terminated by either party without notice at any time for any reason. The provisions of paragraphs 1 (Copyright, Licenses and Idea Submissions), 2 (Use of the Service), 3 (Indemnification), 4 (Third Party Rights) and 6 (Miscellaneous) shall survive any termination of this Agreement.

6.Miscellaneous.

This Agreement shall all be governed and construed in accordance with the laws of The United States of America applicable to agreements made and to be performed in The United States of America. You agree that any legal action or proceeding between Kidawa.com and you for any purpose concerning this Agreement or the parties' obligations hereunder shall be brought exclusively in a federal or state court of competent jurisdiction sitting in The United States of America . Any cause of action or claim you may have with respect to the Service must be commenced within one (1) year after the claim or cause of action arises or such claim or cause of action is barred. Kidawa.com's failure to insist upon or enforce strict performance of any provision of this Agreement shall not be construed as a waiver of any provision or right. Neither the course of conduct between the parties nor trade practice shall act to modify any provision of this Agreement. Kidawa.com may assign its rights and duties under this Agreement to any party at any time without notice to you.

Specific Terms and Conditions:

Emails at registration will not be shared with any other party. Emails are strictly obtained for communication and registration within Kidawa.com
All members must approve upon registration that Kidawa.com reserves the right to email all and any Kidawa.com members important site information anytime. Including (website changes, contest information, any other issues regarding Kidawa.com and its relation with the members.)

Forum postings: including artwork, sales, purchases, and services including any transactions or deals, are all placed under the artist's responsibilities.

All user art uploads are the artist's responsibility.

Kidawa.com is not responsible for any forgery or stolen material by other users and/or websites/parties.
Kidawa.com is not responsible for transactions of products or services for trade or money among users.

Take careful care of uploads. Large images are at high risk of being stolen by other parties. Kidawa.com does not place watermarks on any user uploads within Kidawa.com. We strongly suggest that watermarks/logos always be placed on art images that are intended for public viewing. Always check image size before uploading.

Kidawa.com simply provides a place for artists to present themselves, offer their art and/or services, learn about and enjoy art, and meet and befriend one another as well as clients and enthusiasts.

Kidawa.com assumes no ownership over any user's artwork, unless so agreed upon and given permission by that artist in writing.


Kidawa.com reserves the right to randomly feature any user unless denied permission to do so by that artist; this is intended as courtesy promotion on the user's behalf.
Kidawa.com reserves the right to move Gallery uploads to more suitable areas. If the user does not approve of the new location they may email us a request for a desired location with an explanation on their decision.
We hold the responsibility of our gallery's professional appearance and therefore run a system of organizing art uploads according to not only their type but quality as well.

Forum rules are basic: RESPECT
Respect one another within the forums. No serious negativity please. This does not mean honesty is prohibited. We want to keep the forums as clean, professional, and friendly as possible. We want all folks to feel comfortable with questions and comments, whether they are new artists or seasoned expressionists.

NO pornographic uploads, photographed or expressed in any other way. This does not mean that nudity is prohibited.

Depending on the extremity of a broken rule the user may or may not be given warnings before being deleted off our database with the addition of obtaining a blocked IP address.

Kidawa.com reserves the right to delete uncompleted registrations. Upon registration the user has a 72 hour time period to confirm their registration through their email. After this 72 hour period if the user is still not confirmed, Kidawa.com has the right to delete the registered information.
The user is welcome to register again. This is not always enforced but in order to better control spam and other internet bots, this act is a preferred practice.
